TITLE IX and NON-DISCRIMINATION LAWS

Equity is a core value of the Mooresville Graded School District.  We believe there is inherent worth in all people, and that we have an obligation to ensure all staff, students, and families have the opportunity and access necessary for successful outcomes.  As such, it is the policy of our Board of Education that no student be excluded from, be denied the benefits of, or be subject to discrimination in any education program or activity solely on the basis of age, sex, race, color, religion, national origin, disability, or in employment policies and practices in accordance with Title IX of the Educational Amendments of 1972. Details of this policy are in the Mooresville Graded School District Board Policy Manual.

Title IX Processes

  • If a Title IX Sexual Harassment violation has occurred, a formal complaint form may be submitted by a complainant. A digital form can be found at this link: MGSD Title IX Complaint Form.   For a paper copy to fill out, please click this link (Title IX Printable Complaint Form), fill out the form, and return to your child's school administrator or Tanae Sump-McLean at Central Office.

    Please note that for a complaint to fall under Title IX, it must meet certain definitions:

    1. The allegations of sexual harassment must occur in an education program or activity located within the United States and of which the recipient has actual knowledge;
    2. The sexual harassment is such that a reasonable person would find the unwelcome conduct so severe, pervasive, and objectively offensive that it effectively denies a person equal access to the school’s education program or activity, including conduct based on sex stereotyping.  

    If the behavior does not meet the definition under Title IX, it may still fall under our Board of Education's bullying and harassment policy:  Policy Code 4329/7311:  Bullying and Harassing Behavior Prohibited.

  • Title IX Coordinators, investigators, decision-makers, and those involved in any informal resolution process receive annual training on the following topics:

    All staff (responsible employees) receive training in the Vector Solutions SafeSchools Training module Title IX Compliance Overview. This course is designed to provide school staff with an overview of Title IX regulations to ensure that their school district is in compliance. Topics covered include the role of legal precedent, regulatory and subregulatory guidance related to Title IX; relevant terminology used in Title IX guidance; and guidelines school districts must follow to remain in compliance with the law.

    This training is made up of six sections, followed by an assessment that employees have to score at least a score of 85 percent to receive credit.  The sections of this module include:

    • Obligations of K-12 School Districts
    • Summary
